FL Attorney General files brief in support of Arizona Immigration Law

Attorney General Bill McCollum today announced that  Florida has joined Michigan, seven other states and the territory of the  Mariana Islands in an amicus brief supporting the Arizona immigration law.

Arizona’s law is currently being challenged in federal court by the Obama  administration. The amicus brief was filed today in Arizona.

“I support the current law in Arizona, and I support efforts to see a  similar law brought to our state,” said Attorney General McCollum. “Seeing  no action or leadership from the federal authorities, Arizona has every  right to move to protect its citizens, and for this they are being sued by  the President.”

Earlier this month, the federal government filed a lawsuit against Arizona  alleging that Arizona’s law is preempted by federal law and seeking an  injunction against its enforcement. The amicus brief focuses on state  sovereignty to enforce the law, including enforcement of federal law. The  brief argues that preemption does not exist because Arizona seeks  enforcement that is consistent with federal law.

In addition to Florida and Michigan, Alabama, Nebraska, Pennsylvania,  South Carolina, South Dakota, Virginia, Texas and the territory of the  Mariana Islands all have joined the amicus brief.

Florida, like Arizona, has the sovereign right to use its police powers to  enforce federal immigration laws. Attorney General McCollum is also  working with Florida Representative William Snyder (R-Stuart) to develop  legislation to strengthen Florida’s ability to combat illegal immigration.
