Skidmore files bill to hold banks more accountable for foreclosure proceedings in Florida

Florida Rep. Kelly Skidmore has filed a bill that intends to “make banks carry their fair share of the financial burden by making them more responsive and directly liable to the condominium and homeowners associations for delinquent fees, regular and periodic maintenance and preservation care of units and properties in arrears during foreclosure proceedings.”

HB 959, filed on Feb. 8 is expected to (if passed):

  • Allow a condominium association or homeowners association to prohibit unit owners from using common area facilities if they are delinquent in the payment of association fees by more than 90 days.
  • Provide that a condominium that is less than 75 feet in height and has fire-rated walls of at least 1 ½ hours or higher not be required to retrofit the inside of units with fire alarm systems or smoke-detection systems.
  • Make the lender responsible for the prior twelve months of condominium association unpaid assessments upon issuance of the title at the foreclosure proceeding.  (Current law is capped at 6 months).

Follow the Legislative Process

Skidmore also recently reminded constituents how to follow the legislative process in Tallahassee.  In addition to watching committee meetings and session on the Florida House of Representatives website (www.myfloridahouse.gov), you can also track the progress of any bills that might be of interest to you.

Visit the Florida House of Representatives website and look for the “Bill Finder” link at the top of the screen.  You can search for a specific bill by entering its number, or you can search bill text to find all bills related to a specific topic.  You can also find all the bills sponsored by a particular representative.  Once you find the bill you are looking for, you can read the bill, determine when and where the bill will be heard, find out who is co-sponsoring the bill, who voted for or against the bill, etc.  Once session starts, bills will begin moving through the committee process at a faster pace.  Feel free to call Skidmore’s office if you need assistance in navigating this process at (561) 470-6593.
